Terms of Service

1. Acceptance of Terms

2. Scope of Services

privacyshieldnow provides data protection consultancy, compliance auditing, privacy documentation, consent management implementation, and related data governance services. The specific scope, deliverables, and timelines for each engagement are defined in individual service agreements.

3. Service Execution

All services are executed in accordance with applicable data protection legislation, industry best practices, and the specific requirements outlined in the service agreement. Deliverables are provided in the formats specified in the engagement scope.

4. Client Obligations

Clients are responsible for: providing accurate and complete information necessary for service delivery, granting access to relevant systems and documentation as required, designating authorized personnel for coordination, and ensuring internal approvals for deliverable implementation.

5. Intellectual Property

Upon full payment, all deliverables created specifically for the client become the client's intellectual property. Templates, frameworks, methodologies, and proprietary tools developed by privacyshieldnow remain the intellectual property of privacyshieldnow and are licensed for client use.

6. Confidentiality

Both parties agree to maintain strict confidentiality of all proprietary and sensitive information shared during the engagement. This obligation survives the termination of the service agreement for a period of 5 years.

7. Limitation of Liability

privacyshieldnow's total liability for any claims arising from or related to the services shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We shall not be liable for indirect, consequential, or incidental damages.

8. Termination

Either party may terminate a service agreement with 30 days' written notice. Work completed and expenses incurred prior to termination shall be compensated in full. Termination does not release either party from obligations of confidentiality and intellectual property.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Italy. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Monza e Brianza, Italy.

Refund Policy

1. General Refund Terms

At privacyshieldnow, we are committed to delivering high-quality data protection services. Refunds are evaluated on a case-by-case basis according to the project milestones, deliverables completed, and the specific terms outlined in the service agreement.

2. Pre-Service Refund

If a service has not yet commenced, a full refund may be requested within 14 days of payment. Requests must be submitted in writing to [email protected].

3. Partial Refund

Where work has been partially completed, a proportional refund may be granted based on the percentage of deliverables completed at the time of cancellation. The assessment of completed work is determined by the project milestones defined in the service agreement.

4. Non-Refundable Services

The following are non-refundable: consulting hours already delivered, third-party costs incurred on behalf of the client, and定制 (custom) documentation that has been delivered and accepted by the client.

5. Refund Processing

Approved refunds are processed within 30 business days to the original payment method. The client will be notified via email once the refund has been processed.

6. Dispute Resolution

In the event of a refund dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies. Disputes not resolved through negotiation shall be submitted to the jurisdiction of Monza e Brianza, Italy.
